Terms & Engagement

These Terms & Engagement (“Terms”) govern the provision of services by Motionwave Group (“Motionwave,” “we,” “our,” “us”) to individual and organizational clients across British Columbia and Canada.

 

Motionwave operates and governs a Workforce Stability & Risk Intelligence System supported by non-clinical stabilization coaching. These services are designed for organizational visibility, governance, and decision support under uncertainty.

 

Motionwave is not a clinical, medical, or therapeutic provider.

1. Nature of Services (Non-Clinical)

 

Motionwave provides non-clinical workforce stability and risk intelligence services to organizations, supported by structured stabilization coaching.

 

Our services are designed to:

 

  • Surface early, non-identifying signals of workforce instability and volatility

  • Improve decision timing and governance under uncertainty

  • Support ethical, non-surveillant use of human data

 

Motionwave’s services do not constitute:

 

  • Counselling, psychotherapy, or treatment

  • Diagnosis or clinical assessment

  • Medical or mental-health services

  • Crisis intervention beyond stabilization and referral

 

If clinical or emergency support is required, Motionwave will pause services and recommend appropriate referral.

2. Workforce Stability & Risk Intelligence System

 

Motionwave operates a governed system that generates organizational-level insight into workforce stability, readiness, and risk conditions.

 

The system:

 

  • Relies on aggregate, non-identifying inputs

  • Produces directional, metrics-based signals, not conclusions

  • Is designed to inform executive judgment, not prescribe action

  • Is governed by strict separation of roles and data access

 

The system does not:

 

  • Evaluate individuals or teams

  • Predict individual behaviour

  • Authorize interventions or decisions

  • Integrate into HR, disciplinary, or performance systems

 

Signals produced by the system describe patterns and movement, not causes or responsibilities. ​


3. Role of Stabilization Coaching 

 

Stabilization coaching is an integral delivery layer of the Motionwave system.

 

Its purpose is to:

 

  • Support short-term behavioural stability where applied, reducing the likelihood that concentrated risk manifests as downstream operational impact

  • Increase participation, continuity and signal expression, improving the clarity and timing of aggregated risk patterns

  • Operate within strict non-clinical boundaries

  • Remain fully separated from analytics and interpretation

 

Coaching is:

 

  • Present-focused and structure-driven

  • Non-diagnostic and non-therapeutic

  • Delivered without access to system data or outputs

 

Coaching outcomes are not used to:

 

  • Evaluate system performance

  • Measure organizational success

  • Justify decisions or actions

 

The system is validated by signal behaviour and governance discipline, not by coaching results.

 

4. Scope of Coaching

 

Coaching is limited to:

 

  • Emotional regulation (non-clinical)

  • Behavioural stability and consistency

  • Habit, routine, and reliability support

  • Present-focused accountability and skill-building

 

Coaching does not involve:

 

  • Trauma processing

  • Diagnosis or treatment

  • Clinical intervention

  • Performance evaluation

5. Service Agreement Requirement

 

All Motionwave services are governed by executed written agreements, which may include:

 

  • Services Agreement

  • Statement of Work

  • Consent & Privacy Agreement

  • Non-Disclosure Agreement

 

These documents define:

 

  • Scope of services

  • Confidentiality and escalation limits

  • Data handling and governance protections

  • Fees, cancellations, and refunds

  • Employer-specific provisions (if applicable)

 

Services will not begin until the required agreements are fully executed.

6. Confidentiality & Legal Limits

 

Motionwave protects confidentiality in accordance with the Personal Information Protection Act (PIPA) of British Columbia.

 

Information is not disclosed without written consent except where legally required, including:

 

  • Risk of serious harm to self or others

  • Court orders, subpoenas, or statutory obligations

 

Full details are provided in the Privacy Policy and applicable agreements.

7. Communication, Delivery & Boundaries

 

Motionwave services are delivered virtually by default. Coaching, stabilization support, and system-related interactions may be provided through secure virtual platforms or other remote methods deemed appropriate by Motionwave.

 

Any in-person or on-site services are optional, subject to availability, and must be explicitly agreed to in writing as part of the applicable Service Agreement or Statement of Work. The absence of on-site delivery does not constitute a failure to provide services or support.

 

Between scheduled sessions, communication is limited to brief coordination, scheduling, or system-related clarification. Motionwave does not provide continuous availability, on-demand access, or real-time response guarantees unless explicitly stated in writing.

 

Motionwave services do not include emergency or crisis response services. However, brief, non-clinical stabilization support may be offered when appropriate to help individuals regain short-term regulation and orientation while appropriate external supports are engaged.

 

In emergency situations or where immediate clinical intervention is required, individuals must contact local emergency services or qualified clinical providers directly. Motionwave does not replace emergency services, healthcare providers, or employee assistance programs

8. Fees, Payment & Cancellations

​

  • Fees are defined in the applicable executed agreement

  • Payment is due at booking unless otherwise agreed

  • Missed or late-cancelled sessions may be billed in full

  • Employer programs may include alternative invoicing or pilot-phase terms

 

Refunds are available only if services have not begun and a request is made within seven (7) days of purchase, unless otherwise specified in writing.

9. Employer Programs & Workforce Stability System

​

9.1 Nature of Data Collected

 

The system may collect confidential, self-reported inputs such as:

​

  • Stability and readiness indicators

  • Emotional regulation patterns

  • Participation and engagement signals

  • Micro-pulse and baseline survey responses

​

All data is stored using system-generated codes, never employee names.

​

9.2 What Employers Receive

 

Employers receive aggregated, de-identified outputs, such as:

​

  • Workforce stability ranges

  • Early-warning operational indicators

  • Group-level readiness patterns

  • Correlation summaries

​

Employers never receive:

​

  • Individual responses or identifiers

  • Coaching notes or session content

  • Personal mental-health information

​​

9.3 Prohibited Use of Data 

 

Employers agree not to use Motionwave for:

​

  • Discipline or termination

  • Performance management

  • Employment decisions

  • Fitness-for-duty determinations

  • Surveillance or individual monitoring

​

The system provides organizational visibility, not individual evaluation.​

​

9.4 Escalation & Safety

 

If an individual communicates:

​

  • Intent to self-harm

  • Intent to harm others

  • Severe psychological distress

​

Motionwave will:

​

  1. Pause coaching immediately

  2. Apply stabilization protocols

  3. Refer to appropriate clinical or emergency services

  4. Notify designated safety contacts only as legally required

  5. Document the event using non-identifying codes

​

9.5 Data Separation

 

Motionwave maintains separate systems for:

​

  • Individual coded data

  • Aggregated employer reports

​

No system permits re-identification of individuals.

​

9.6 Forecasting Disclaimer

 

Forecasting outputs are:

​

  • Directional

  • Non-diagnostic

  • Probabilistic

  • Dependent on participation and data completeness

​

Forecasting does not predict individual behaviour and does not guarantee avoidance of adverse outcomes. 

​

7.8 No Guarantee of Outcomes

 

Motionwave does not guarantee:

​

  • Specific workforce outcomes

  • Incident reduction

  • Turnover elimination

  • Financial or operational results

​

Outcomes depend on organizational context, leadership behaviour, and participation.

​

10. Professional Standards

 

Motionwave adheres to ethical standards consistent with recognized recovery coaching bodies, including:

​

  • Recovery Coaches Canada (RCC)

  • Canadian Addiction Counsellors Certification Federation (CACCF)

  • International Coaching Federation (ICF)

​

This includes commitments to confidentiality, autonomy, professionalism, and respect.​ These standards inform ethical conduct and boundaries but do not define the services as clinical, therapeutic, or health-care related. 

​

11. Liability & Insurance

 

Motionwave maintains appropriate professional and general liability insurance for non-clinical coaching services in British Columbia.

​

Motionwave is not a regulated healthcare provider.

​

12. Limitation of Liability

 

Clients acknowledge that coaching outcomes depend on individual and organizational factors.


Motionwave is not responsible for decisions or actions taken based on system outputs, coaching sessions, or materials.

11. Governing Law

 

These Terms are governed by the laws of the Province of British Columbia and the laws of Canada.
